THE FASCELL AMENDMENT PROHIBITS THE USE OF FUNDS FOR THE PROCUREMENT OF BINARY CHEMICAL MUNITIONS UNTIL SEPTEMBER 30, 1987, AFTER WHICHPROCUREMENT MAY PROCEED IF THE PRESIDENT CERTIFIES TO CONGRESS THE NEED FOR SUCH WEAPONS, A CONTROL AGREEMENT HAS NOT BEEN ENTERED INTO BY THE UNITED STATES, AND THAT THE TWO CHEMICAL COMPONENTS ARE STORED IN SEPARATE STATES.
