Description: TO PASS H.R. 15223, STRENGTHENING THE LAWS GOVERNING THE TRANSPORTATION OF HAZARDOUS MATERIALS.

Bill summary: Federal Railroad Safety and Hazardous Materials Transportation Amendments - Authorizes not more than $35,000,000 to be appropriated for specified uses for fiscal year 1975 to carry out the purposes of the Federal Railroad Safety Act of 1970. Requires the Secretary of Transportation to prepare and submit to the President for transmittal to the Congress a report on Federal railroad safety standards and state railroad safety programs planned or underway. Increases the penalties for common carriers (...show more) failing to make accident reports within the time required by law. Authorizes to be appropriated not more than $3,000,000 to carry out the purposes of the Hazardous Materials Transportation Control Act of 1970. Provides that, in order to assure safe transportation of hazardous materials in interstate and foreign commerce, the Secretary may prescribe regulations applicable to: (1) the manufacture, fabrication, marking, maintenance, reconditioning, repair, testing, and distribution of packages or containers which may be used for such transportation of hazardous materials; and (2) any carrier who engages in interstate or foreign transportation and who transports hazardous materials and any shipper who transports hazardous materials by carrier. Establishes civil penalties for violations of such regulations. Increases the civil and criminal penalties which may be imposed for violations of the Federal Aviation Act of 1958 with respect to the transportation of hazardous materials. Provides for the delegation by the Secretary of Transportation of all functions with respect to enforcement of regulations pertaining to the transportation of dangerous articles to the Federal Railroad Administrator and the Federal Highway Administrator. Provides that the Secretary of Transportation shall issue regulations governing the rail transportation of explosives as soon as practicable after the date of enactment of this Act.
